After the biological parent receives notice of the request, he/she would have the opportunity to formally object or consent.
There is a process to request the Adoption over the objection of a parent who has failed to maintain a parental relationship with the child(ren). Also, if the parent has failed to pay Child Support for a legally mandated time frame, the Step-Parent Adoption could move forward over the objection of the parent.
If the parent is permitted to object, the Court will hold a hearing to determine what is in the child's best interest. There are also required background checks during the process.
